Court
Appointed Attorneys
|
In criminal cases,
a defendant may choose to hire or retain an attorney to give legal
advice and to represent them in all court proceedings.
If
a defendant desires an attorney but is unable to afford one and the offense charged is punishable by incarceration in jail or
prison (a Class 1 or 2 misdemeanor or a felony), then a Public
Defender may be appointed by the Court to represent the defendant. The Court will require the Defendant to complete a financial
disclosure form listing all of his/her assets, income, liabilities
and expenses to determine whether he or she is qualified for a Public
Defender. If a Public
Defender is appointed to represent the defendant and the defendant is convicted,
the defendant will be charged for the fees of the attorney as a part
of their court costs.
