In order to file
a suit in Civil Court, you will need to come to the Clerk’s office
in the Public Safety
Building, Room 183 between the hours of 8:00 am to 4:00
pm. If you
have the proper forms, you may mail the forms and the appropriate
fees to
the Clerk’s office. In
order to insure you have the correct fees, forms, return date
and courtroom, you may wish to call the clerk’s office before
mailing your paperwork (664-4913).
When filing your
claim, you will need the correct name and address of the person(s)
or business you are suing, the amount of your claim and the reason
you are suing. With
regard to the correct name of a business or corporation, and the
correct serving party, you can obtain assistance from such sources
as the Better Business Bureau, City License Bureau and the State
Corporation Commission.
If your defendant is in the military, you should tell the
clerk when you are filing your claim, as other procedures will
need to be followed in order to collect on your judgment.
When your paperwork
is filed, you will be given a court date (return date) to come
to court. You will
need to be present on this date.
