An encroachment is any object of private ownership (i.e. awning, fence, building), existing or proposed, that extends into the public right of way. These encroachments are permitted only by ordinance. An application to request the ordinance is reviewed by City agencies that are affected by the encroachment. If review comments are positive or can be accommodated, an ordinance allowing the encroachment is prepared for action by City Council. Encroachments require the City be insured against liability and exist at the pleasure of the City Council.
