ACTION OF THE COUNCIL

 

TUESDAY, APRIL 15, 2008 – 2:30 P.M.

 

                   President Fraim called the meeting to order, all members were present.

 

                   Prayer offered by Councilman Paul R. Riddick, followed by the Pledge of Allegiance.

 

President Fraim moved to dispense with the reading of the minutes of the previous meeting.

 

                   Motion adopted.

CERTIFICATION OF CLOSED MEETING

 

A Resolution entitled, "A Resolution certifying a closed meeting of the Council of the City of Norfolk in accordance with the provisions of the Virginia Freedom of Information Act," was introduced in writing and read by its title.

 

                  The Resolution as introduced was adopted, effective April 15, 2008.

CEREMONIAL MATTER

 

President Fraim read a proclamation proclaiming April 13-19 2008, National Telecommunicators Week in the City of Norfolk. Mr. Ron Keys, Director of EOC and several colleagues accepted the proclamation.

 

PUBLIC HEARINGS

                                                               

PH-1                                                   PUBLIC HEARING scheduled this day pursuant to action of the Council on March 18, 2008, under the State law, public notice having been inserted in the local press by the City Clerk on the application of Franciscus Homes, to amend The General Plan of Norfolk, 1992, from Low Density Residential to Medium Residential and for a change of zoning from R-7 (One-Family) District to Conditional R-11 (Moderate Density Multiple Family) and for a Special Exception to allow more than six units on property located at the southeast corner of Kempsville Road and Cornick Road.

 

                   Richard Rutyna, 1228 Lower Court, spoke concerning this matter.

 

ACTION:   Matter continued to May 13, 2008.

PH-2                                                   PUBLIC HEARING scheduled this day under the State law, public notice having been inserted in the local press by the City Clerk on the application of Metro Housing, to amend The General Plan of Norfolk, 1992, from Low Density Residential to High Density Residential, for a change of zoning from C-2 (Corridor Commercial) District to Conditional R-14 (High Density Multiple Family) District and for a Special Exception to allow more than six units on property located 3706 and 3710 Colley Avenue.

 

Mr. Lee Chepy, 229 West Bute Street and Mr. Joe Covington, 6061 River Crescent, were present on behalf of this matter.

 

Thereupon, an Ordinance entitled, “An Ordinance to amend the General Plan of Norfolk, 1992, SO AS TO change the land use designation for property located at 3706 and 3710 Colley Avenue from Low Density Residential to High Density Residential,” was introduced in writing and read by its title.

ACTION:   The Ordinance as introduced was adopted, effective April 15, 2008.

ACTION:   The Ordinance as introduced was adopted, effective April 15, 2008.

PH-2B                            An Ordinance entitled, “An Ordinance granting a Special Exception to permit the construction of seven or more dwelling units on property located at 3706 and 3710 Colley Avenue,” was introduced in writing and read by its title.

 

ACTION:   The Ordinance as introduced was adopted, effective April 15, 2008.

PH-3                               PUBLIC HEARING scheduled this day pursuant to action of the Council on April 1, 2008, under the State law, public notice having been inserted in the local press by the City Clerk to hear comments to approve a lease agreement between the City and Aeran Enterprises, LLC, on property located at 240 East Main Street.

 

Thereupon, an Ordinance entitled, “An Ordinance approving a lease agreement between the City of Norfolk, as Lessor, and Aeran Enterprises, LLC, as Lessee, for the lease of certain property owned by the City at 240 East Main Street and authorizing the City Manager to execute the lease agreement on behalf of the City,” was introduced in writing and read by its title.

 

ACTION:   The Ordinance as introduced was adopted, effective May 16, 2008.

              CONSENT AGENDA

 

C-1                                 Letter from the City Manager requesting a public hearing be scheduled to hear comments to close, vacate and discontinue a portion of 20th street at the northeast corner of 20th Street and Llewellyn Avenue.

 

ACTION:   City Clerk authorized to advertise for a public hearing on April 29, 2008.

NEW BUSINESS

                                                               

1.      Gary Dubour, 1433 Kingston Avenue, asked what would be the cost involved to build a new Hampton Roads tunnel or a bridge.

 

2.      Daniel Montague, 4605 Krick Street, recommend locating an off-track betting outlet at the Waterside Market Place.

 

3.      Danny Lee Ginn, 3844 Dare Circle, commented about why he keeps coming to speak at Council meetings.
